Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ATIP.ca website and services, including GCMS-Notes.ca and any related platforms (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who We Are

ATIP.ca (“ATIP.ca”, “we”, “us”, or “our”) provides online services that assist users with obtaining Access to Information and Privacy (ATIP) requests, GCMS notes, and related support services.

2. Eligibility

To use the Services, you must:

  • Be at least 18 years of age, and
  • Be legally able to enter into a binding agreement in your jurisdiction

By using the Services, you confirm that these conditions are met.

3. Your Responsibilities

You agree to:

  • Provide accurate and complete information
  • Use the Services only for lawful purposes
  • Not misuse, copy, resell, or exploit the Services or their content

You are responsible for keeping your account credentials confidential and for all activities carried out under your account.

4. No Legal Advice

ATIP.ca is not a law firm and does not provide legal advice. Information provided through the Services is for informational purposes only and should not be interpreted as legal advice.
If you require legal advice, consult a licensed immigration lawyer or consultant.

5. Orders, Payments & Billing

  1. Payment Processing
    Payments are processed securely by third-party providers such as Stripe. We do not store full credit card details.
  2. Pricing
    Pricing is displayed on the website and may change at any time. Changes do not affect completed orders.
  3. Refunds
    Due to the nature of digital services and government-submitted requests, all purchases are final and non-refundable once processing has begun, except where required by law.
    Any refund granted at our discretion is a one-time exception and not a precedent.
  4. Chargebacks
    Filing an unjustified chargeback violates these Terms. We reserve the right to dispute chargebacks, suspend accounts, and refuse future service.

6. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information. By using the Services, you consent to the handling of your information as described in that policy.

7. Third-Party Providers and Subcontractors

To operate the Services, we may work with trusted third-party providers, subcontractors, independent immigration professionals and other parties.

By using the Services, you authorize us to share information with them as needed to deliver the Services.

We are not responsible for the actions of third-party providers beyond what is permitted by law.

8. Communications

By using the Services, you agree that we may send you transactional messages, service-related updates, and marketing communications. You may opt out of marketing emails at any time.

9. Prohibited Activities

You agree not to:

  • Use the Services for unlawful or fraudulent purposes
  • Interfere with or disrupt the Services or related systems
  • Access data not intended for you
  • Reverse-engineer, copy, reproduce, or resell any part of the Services

We may suspend or terminate your access for violating this section.

10. Service Availability & Changes

We may modify, suspend, or discontinue any part of the Services at any time without liability.
We do not guarantee continuous, uninterrupted access. The Services are provided “as available.”

11. No Guarantees

We do not guarantee:

  • Any specific outcome or result from using the Services
  • Approval, processing speed, or responses from government agencies
  • Accuracy or completeness of information obtained from third parties

Government processing timelines and decisions are outside our control.

12. Limitation of Liability

To the fullest extent permitted by law:

  • The Services are provided “as-is” and “as-available”
  • ATIP.ca is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages
  • If we are found liable, our total liability will not exceed the amount you paid for the Services in the 3 months before the event giving rise to the claim

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold ATIP.ca (and its sibling or parent companies) harmless from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising from your misuse of the Services or violation of these Terms.

14. Account Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • We suspect fraud, abuse, or harm to others
  • We are required to do so for legal or regulatory reasons

You may stop using the Services at any time. Termination does not entitle you to a refund.

15. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date below reflects the latest version. Continued use of the Services after changes means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes must be resolved in Ontario, Canada.
